fire was coming out of. so pg&e has their own shutoff that are in the street for this kind of thing and it worked out find. >> reporter: the battalion chief was talking about a gas line rupture happening while they were battling the flames. pg&e said the fire broke the gas stop. so pg&e was called in to shut off the gas. pg&e crews were mopping up in the area. arson investigators will return to determine the cause. live in san francisco, cate caugiran, cbs 5. three members and one family died in a weekend fire in east san jose. a couple and their 4-year-old granddaughter were trapped on the upper floor. firefighters arrived in just minutes but the entire building was already engulfed in flames. >> this fire somehow got a really big head start on us.

it burned hot and it burned very fast. it consumed most of the apartment even within a three minute response time for us. >> the two victims had lived in the complex for about 20 years. their granddaughter also died. and another family member was reported to be in intensive care. two other people suffered smoke inhalation including a san jose police officer who tried to help those victims. a new health problem for secretary of state hillary clinton. she is in a hospital in new york this morning with a blood clot. her doctors discovered the clot yesterday in a follow-up exam following a concussion she suffered earlier this month. her spokesman says the clot is related to the concussion. but he is not saying where the clot is located. she is being treated now with anticoagulants and will stay in the hospital for the next couple of days. 15 hours and counting down. the fiscal negotiations in washington are really coming down to the wire now. cbs news's danielle nottingham

joins us live from d.c., where the house is set to convene in an hour. >> reporter: good morning. the senate will reconvene a couple of hours after that. and over the weekend, the senate's two top leaders couldn't work out a deal, so they asked vice president joe biden to step in and try to help. and with just hours to go until this deadline, it's unclear if we'll see a deal today. lawmakers left the capital sunday night without a deal but leaders from both parties expressed their willingness to continue working. >> there's still significant distance between the two sides. but negotiations continue. >> i want everyone to know i'm willing to get this done, but i need a dance partner. >> reporter: some progress was made sunday when republicans dropped a proposal to slow social security growth. but the main sticking upon the between democrats and republicans continues to be over the threshold of tax

increases. president obama campaigned on raising taxes on income over $250,000. while many congressional republicans have pushed back against any tax increases. president obama is placing the blame for the impasse on the gop. >> they say that their biggest priority is making sure we deal with the deficit in a serious way. but the way they're behaving is that their only provide or the is making sure that tax breaks for the wealthiest americans are protected. >> reporter: but senators say there is some movement on the issue. >> there's a lot of give and take going on right now. but republicans don't want to see new revenues -- in other words, democrat tax increases -- being used for new spending. >> reporter: the president has said if there is no deal by the end of the day, the senate should draw up legislation to extend the bush-era tax cuts for the middle class. >> there should be an up-or- down vote. everybody have should a right to vote on that. if republicans don't like it, they can vote no. but i actually think there's a majority support for making sure that middle class families

are held harmless. >> reporter: a white house proposal to increase he is stat taxes also held up negotiations over the weekend. now, if the senate is able to come up with a bipartisan agreement today, it still has to get through the republican- controlled house. live on capitol hill, danielle nottingham, back to you. >> time is counting down, danielle. so what happens if lawmakers don't major the deadline? >> reporter: if they don't, we see $500 billion in tax increases and that will affect almost every american's tax rates. we'll also see unemployment benefits expire for millions and also, those automatic spending cuts, those will affect the defense department, other federal agencies. so there are some immediate effects here, michelle. >> we're looking at some live pictures now of the house floor. tell me, what will the president do if the senate cannot come up with an

13 and 16 years old. it brings oakland's homicide total to 131 for 2012. that is a 27% increase from 2011. here in san francisco, 67 murders for the year, a one- third increase over 2011. san jose's 45 relatively low for a city of its side but still 12.5% higher than last year. police think the driver who crashed into a concord funeral home was involved in a street race. a 16-year-old was behind the wheel of a 1974 chevy nova. police say the teenager was going well over the 40-mile-an- hour speed limit. and apparently he was racing another 16-year-old. a service was just beginning when the car crashed into the ouimet brothers funeral chapel. >> literally five seconds after i had entered the side room we heard what we thought was an earthquake and turned around and saw the car careen through the front of the building. luckily, there was nobody there. i am very grateful to the priest for ushering everybody

in. >> two teenagers in the car and one man in the funeral home were injured. no one was arrested. the numbers of drunk driving arrests and of fatal accidents are down this holiday weekend compared to last year. the chp made 723 drunk driving arrests since friday night across the state, more than 200 fewer than last year. accidents killed 9 people in california, down from 12 in the same period a year ago. and as elizabeth mentioned, local transit agencies are offering an alternative to driving tonight. caltrain will offer free rides after 11 tonight for passengers riding south from san francisco. muni will offer free rides from 8 p.m. to 6 a.m. in san jose and silicon valley all vta bus and light rail will be free between 6 p.m. and 4 a.m. bart will extend its service until 3 a.m., but no free

he really wants to hear those three little words: chevron with techron. care for your car. embankment in eastern orego state police say the bus crh nine people are dead and two dozen others injured after a tour bus plunged down an embankment in eastern oregon. it crashed through a guardrail on i-84 near pendleton yesterday morning before plummetting 1 00 feet. that stretch of freeway was covered with snow and ice at the time. caught on camera the crash of a commercial jetliner in russia. the aftermath, a camera inside a car on amos ceo freeway actually showing the moment of impact on saturday. debris went flying all across the road striking a number of cars there. you can hear the sound. it happened as the plane slammed into the ground short of the runway. five crewmembers were killed.

there were no passengers on board that plane. a big scare for passengers on a united airlines plane that lost an engine panel and had to turn around. can you imagine? this is a photograph of the engine minus the panel that cam off yesterday morning. the missing piece was found on the runway at kansas city international airport. the plane this just taken off for denver. a radar image shows the plane's path. the pilot circled kansas city for 30 minutes to burn off some fuel. a passenger said the flight attendants were shaken but the plane landed safely, no one was injured. the aircraft is getting a full inspection. not a good sign when the flight attendants are shaken. >> you can see the engine from the window and you're look, oh, my god, you know? that's scary. >> a little scary. >> i bet traffic is light. >> yeah. >> just a get. >> not scary out the . >> we're falling asleep over here in the traffic department. almost nothing going on. we have a fender-bender but as you can see there is no delay

and i'm frank mallicoat. tis 6-- developing news from san francisco... ars good morning. it's monday, december 31. new year's eve, i'm michelle griego. >> is it new year's eve? >> it is. >> hi, everyone. i'm frank mallicoat. it is 6:30 on the nose now. we have developing news here in san francisco. arson investigators are looking into a suspicious house fire. >> cbs 5 reporter cate caugiran is live in the excelsior district where a gas leak made things difficult for crews. good morning, cate. >> reporter: good morning, michelle. the cause of this fire is still under investigation. but firefighters told me earlier it raised eyebrows with them because it spread so quickly. the fire started in a home near athens street and peru just before 1:00 this morning. the fire spread fast throughout the home, and firefighters worked against the clock to contain it. but crews say they faced one major challenge. >> what we got here is the entire house was on fire. we were able to contain that and control it. but the gas line also ruptured on us at the shutoff.

all americans will increase. democrats say it means about $2,000 for the average middle class family. >> one mom said to me in michigan, that's four months groceries. that's commuting back and forth to work in gas for up to three years. i mean, that's a lot of money. >> reporter: democrats want higher taxes on families earning $250,000 a year and over. republicans want tax rates to stay where they are. taxes seem to be the biggest obstacle to a compromise but others want to see government spending put in check. >> the president is doing nothing about the addiction of his administration that he has to spending. he's the "spender-in-chief." >> reporter: president obama says he is willing to do that. >> i offered over a trillion dollars in additional spending cuts so that we would have $2 of spending cuts for every $1 of increased revenue. >> the senate is in recess. >> reporter: the senate reconvenes this morning so as americans celebrate the beginning of 2013, they may wake up wishing it were 2012 when they had more money in their pockets. i'm andrew spencer reporting.

county... this is cell phone check out, it's a daring rescue nearly a dozen people landing in some icy water in the mountains in l.a. county. this is cell phone video taken at jackson lake. just south of lancaster. a couple witnessed the person falling through some thin ice after sledding down the hill right into the lake. >> it was hard to watch. it really was. we saw that guy go under three times and the third time we didn't think he was coming back up. >> tried to help only to find themselves falling into the frigid water. everyone in the water eventually was able to get out with a rope. but that looked thin. >> what do you do when you see someone struggling? do you go in after this em? >> that's a hard call. i did the same thing with my brother and he grabbed my hand and pulled me in the water but we're here today! >> you made it. >> we made it through. around the bay area today it's

a frosty start to the day especially in some of the valleys. clouds passing through overnight. we are looking at a nice new year's eve. a couple of clouds outside with chilly temperatures out the door this evening. it should be a great night to view the fireworks around the bay area. high pressure holding on here, but it's a whack ridge and a lot of these clouds will slide over the top of the ridge today so still some cool temperatures outside. and a lot of passing clouds. around the state 50s in the central valley, 30s and 40s into the high country. i think today your futurecast model will show you passing clouds sliding through. we should stay dry even through the midnight hour. i think we'll stay dry most of the clouds and the rain stays off the coastline so with that in mind, looks look a good end to 2012. plan on 50 cool in concord today 51 in livermore and about 51 in san francisco. looking out to 2013 a mostly dry week ahead the one exception late in the week a chance of rain does return as

we look toward next weekend. that's a look at weather. let's check traffic with elizabeth. >> what there is of it. it is pretty quiet all over on bay area roads. so show you a few live traffic cameras. this is 280 coming into san francisco. you can see the skyline there in the distant. northbound and southbound light volumes this morning. this is how you know it's a holiday the bay bridge. no metering lights, no delay heading into san francisco right now at 6:46. if you are doing some driving this morning, be careful on san pablo dam road. that seems to be the issue so far this morning. chp is reporting black ice. there was an overturn sounds like injury crash in el sobrante. also black ice reported in orinda. possibly a second accident approaching bear creek road so again, that seems to be the problem spot this morning. they are sending emergency crews out to the scene. in the meantime, this accident is now cleared to the right- hand shoulder in milpitas, northbound 680 by 27. we'll have more coming up. in the meantime, back to you guys.

>> thank you. a new year means a bunch of new laws will take effect. "san francisco examiner" columnist melissa griffin has a look at some of the changes we'll see that start tomorrow. >> good morning. >> reporter: good morning. happy new year. >> happy new year. >> reporter: the way the state legislature works when they pass laws in a particular session they take effect in january of the following years so laws passed in the 2012 session in sacramento are all starting tomorrow. here are a few you might find interesting. first, certain undocumented immigrants are going to be able to get driver's licenses. so you may recall that last year, the obama administration rolled out something called the "deferred action for childhood arrivals." and that allows people to stay for up to two years if they were brought here under 16 years old if they're in high school or have completed high school, if they're in the military or have completed military service and no criminal records. now, what the new law in california says is that the permits that are going to be issued by the federal government under this program will be be able to be used to

get driver's licenses. so certain people again if you meet certain criteria will be able to get those licenses. another law that's taking effect is texting law. this new law says that anybody who is texting while driving is totally fine and legal as long as they're not using their hands. so some phones have these voice actvated systems that allow you to voice text. that's going to be okay under the new law. this is a bit controversial because there aren't any studies that say this is any safer than the hands -- >> you still need the finger to hit the voice. >> but. >> reporter: the cop sees you do that you're done. if you are just talking, you're fine. there's also a homeowners bill of rights law that prevents banks from dual tracking which is foreclosing on a house while at the same time refinancing the house. this can be confusing. that's prohibited. and finally, a law aimed directly at the controversial westboro baptist church, it

will now be a crime to picket within 300 feet of a funeral one hour before, during the funeral and one hour after. >> that is only in california? >> only in california. >> you think that will stop them? >> they say that they are going to abide by the law for now but they are also gearing up for a lawsuit alleging that this is a violation of their first amendment rights. >> can i say this one last time? "fiscal cliff"? closed for the holiday. today is the last trading day of the year on wall street. investors are keeping a close eye on the "fiscal cliff" negotiations. with the deadline at midnight, let's head to wall street see where we stand as investors are watching closely to see what happens. as you can see the dow and the nasdaq are mixed at this point. the dow is down by 23 points. the nasdaq is higher by almost 7 points. ford motors had another banger -- banner year. they said they sold 2.2 million vehicles in the u.s. in 2012. that's up from 2.1 million last year. the ford focus is their most popular model. this is the second year in a row ford has topped two million in sales. the only u.s. car company to do that. and there may not be many happy returns this year especially if you don't have your receipt. the national retail federation says $63 billion worth of presents will be taken back to stores but receipts could be critical in making a return

successful because many stores are tightening their rules on refunds and exchanges. $63billion. that's a lot of unhappy gifts there that they got, i guess. >> you know what? i'm so surprised, ashley. i haven't had to return anything this year. it's great. >> reporter: no, well you're a very happy person this year, you get what you want. >> i haven't either. >> i get the millionaires hadn't happy. they are not partying. >> reporter: apparently not or if theroux cheap about it. it seems even the wealthiest are looking to scale back. a survey of millionaires found 87% plan to spend less than $200 on new year's eve and 3% say they don't even plan to party at all. i'm not sure if i actually fall in the don't plan to party at all because i'm going to be sitting on the sofa and i have remote all to myself and for me that's a party. >> having a party to me, too. >> if you get up at 2:30, you either stay up all night or go

the fire in the excelsior district started about one 6:57. no word on what started a suspicious fire here in san francisco this morning. the fire in the excelsior district started around 1:00 this morning. it damaged a home and sent two people to the hospital. they are expected to be okay, though. the fire department had to call pg&e to the scene because they couldn't shut off the gas to that burning home. secretary of state hillary clinton is under observation in the hospital in new york after doctors discovered a blood clot following a concussion she had earlier this month. a spokesman for clinton says the clot is related to the concussion but he is not saying exactly where the clot is located. 65-year-old clinton is now taking anticoagulants. and the house of representatives will reconvene in about 10 minutes to work on a fiscal solution before
